Travis Barker spoke out last night about the lawsuit he filed against the owners and makers of the Learjet that he barely escaped from when it crashed in September. E! News reports:

"I wouldn't have been in the state I was in if I wasn't in the crash," said Barker, who spoke Sunday while at the Miss California USA event with Shanna Moakler. "I wouldn't have third-degree burns all over my body or be prohibited to do certain things. I can't go swimming. I can't do some of the things that normal people can do. I didn't ask for that to happen."
The drummer says he doesn't know if he'll win his lawsuit.
"I don't know. I just think positive. I mean, I think so—if something goes wrong that's not supposed to go wrong or you fall victim of it, I think you should be compensated."

DJ AM who also survived the fiery crash is not part of the lawsuit, according to Travis, "I can't speak for him—I think everyone just has different attorneys." Which means DJ AM's lawyers used the old legal maneuver of "let the jackass go first." Congratulations, Travis Barker, you're a guinea pig. And did I mention jackass?

Travis Barker is filing a negligence lawsuit against the owners and makers of the Learjet that left four people dead and the former Blink 182 drummer, along with DJ AM, severely burnt. According to recordings released by the Federal Aviation Administration this week, the plane had hit a speed of 153 mph when a tire blew. The Monday morning quarterback consensus is the pilots should've taken off and burnt off fuel. Instead they drove off the runway which brings us to Travis' suit. E! News reports:

Per court documents filed Friday in Los Angeles Superior Court, Barker's camp believes that "one or more of the tires failed, leaving tire debris and portions of airplane components along the 8,600 foot runway" and the pilot made a "negligent attempt to abort the takeoff."
"The pilot's decision was a breach of their duty owed to the passengers onboard and was a substantial factor in causing the crash and resultant injuries and deaths," the suit continues.
Moreover, the jet's "landing gear, tires, wheels, brakes, reverse thrust system, squat switches and component parts were not airworthy."

DJ AM is learning that surviving a fiery plane crash is the number one panty dropper. Since checking out of the hospital, he's rekindled his relationship with Mandy Moore who flew to his side in the days following his escape from a deadly plane crash with Travis Barker. The couple were photographed together over the weekend (above) and aren't being shy about the reunion, according to Us Weekly:

"It's back on," a DJ A.M. source says in the newest issue of Us Weekly , on stands now. "Since the accident, it's blossomed into something again."
Continues the insider, "Mandy said, 'I like this guy a lot and I want to see where it can go again. Life is too short to not be with someone you really care about.'"
Says a second DJ A.M. source, "When you go through what Adam went through, you need people you love and people who love you. He will never stop loving her."

Maybe I'm an old softie, but I think Mandy and DJ AM are a perfect fit for each other. No, really. It's hard finding that special someone who can relate to hearing "Jesus, I can't believe you're alive!" every time you go out in public. Best of luck, you two.

Usually, after having a near-death experience, one tends to set aside petty differences and focus on the simple joys of just being alive. Not Travis Barker. Blogging from his hospital bed to thank fans for their support, the former Blink 182 drummer took an awkward potshot at ex-wife Shanna Moakler on his MySpace page:

Despite any rumors you might have heard via my EX-wife Shanna Moakler, who I have not seen since the week I checked in, Ive been treated amazingly well, both here in LA and in Georgia. The hospitals Ive been treated at are THE BEST.

I can guarantee you, my friends, the last thing I'd be doing after a one-in-a-million escape from a fiery plane crash is blogging about my ex. I'd be sniffing every flower, savoring every meal and arguing with every nurse who tries to tell me strippers are a violation of hospital policy: "But they have stethoscopes! That's medical."

Travis Barker has given his first interview to Us Weekly since surviving a plane crash that left four people dead. He's currently being treated in Los Angeles for the second- and third- degree burns that covered the lower half of his body. Here's what Travis had to say:

"I hate planes," the ex-Blink 182 drummer, 32, tells Us exclusively. "My biggest fear ever is to be involved in a plane crash, so when that happened ... well, I'm just thankful to be alive! I'm just grateful to be here at all."
How are you doing?
"I am doing the best I can possibly be. I'm so anxious to get out of here. ...I've just been in surgery after surgery. I have third degree burns basically from my feet up to my waist and both hands. One of my hands was second degree burns and one was third degree burns. I'm trying to have a quick recovery and play the drums again and be able to hold my kids again. [Barker has two children, Landon, 5, and Alabama, 2, with Moakler.] I'm going nuts not being able to see them and spend time with them!"

Travis Barker hated flying to begin with then winds up in a plane crash? Jesus. That's like being an arachnophobic and a guy in a Spider-man costume shows up at your birthday party to bang your mom. Not that anyone would ever do such a thing; but, Geekologist, if you're reading this, tell your mom I checked the receipt from the rental place, and it definitely needs dry-cleaned. Oh, and also, doctor says my "web-shooter" is totally cool. False alarm. Thanks, bro!

Plane-crash survivor Travis Barker was discharged from the Joseph M. Still Burn Center in Georgia today well ahead of the two-week mark given by Jermaine Dupri on Friday. DJ AM, who also escaped the crash with Travis, was released Friday. People reports:

"Travis is in good condition and was discharged this morning," Burn Center spokesperson Beth Frits told PEOPLE Monday. "He has left Augusta."

Travis was last seen paddling down Interstate 95 in a canoe. Have you ever seen one of those burst into flames? I rest my case.

Travis Barker is doing well and "feeling the love" from fans, according to his business partner Jermaine Dupri. Travis, along with DJ AM, are in the hospital after suffering severe burns when they escaped a plane crash that left four of his friends dead. People reports:

Barker's improved spirits could be due to his newly outfitted hospital room: "He's just now getting everything in the hospital set up for him – iPods, computers, everything that he needs," says Dupri, who estimates Barker will be in the hospital another two weeks. "You got to make sure he is comfortable."

I hope he likes the model planes I sent. Get well soon, Travis!

UPDATE: DJ AM just got out. That's gotta burn I'm going to Hell.

Sep 21 2008Travis Barker & DJ AM expected to make 'full recovery' after surviving plane crash


For the few of you who haven't heard, former Blink-182 drummer Travis Barker and DJ AM were the sole survivors of a plane crash Saturday in South Carolina that left four people dead. The two had just performed at a free concert (above) near the University of South Carolina with Perry Farrell and Gavin DeGraw. They are currently being treated at the Joseph M. Still Burn Center for second- and third- degree burns, the AP reports:

"Anybody who can survive a plane crash is pretty lucky," Mullins told reporters during a news conference Sunday morning.
Barker was burned on his torso and lower body and DJ AM, whose real name is Adam Goldstein, was burned on an arm and a portion of his scalp, according to a statement from the musicians' families released by the hospital. Mullins declined to discuss specific recovery times for the men, but said such injuries can take a year to fully heal.
Both men are still in critical but stable condition, he said.

Right before the crash, Travis and DJ AM were lucky enough to dive out of the plane while it was engulfed in flames. An eyewitness, William Owens, watched the wreckage careen across the highway in front of him and came upon the survivors:

"I noticed two guys who were on fire and it looked like a dance: They didn't know what to do," said Owens, a 60-year-old delivery van driver.
Goldstein had stripped off his own shirt and was helping Barker strip naked, said Owens, who was able to identify the men Saturday night because of news reports that showed Barker's extensive tattoos.
Owens said Goldstein told him four other people were on board the jet, but the flames were too intense to get close.
"'Oh my God' was all they were saying," Owens said of Barker and Goldstein. "They stood there and it's like — didn't know what to do. None of us did."

According to a recording recovered from the cockpit by authorities, it appears a tire burst while the plane was near its 92 mph take-off speed.
