Proposition 8 went before the people of California and was signed into law in a lawful, legal election. Regardless of your opinions on this issue, it is not the job of the supreme court of overturn the will of the people. They ruled that under the California constitution, gay people could get married, so the voters then amended the constitution defining marriage as between a man and a woman. That's called democracy.

Previously activist groups have had great success in doing end-arounds (so to speak) with the courts when voters vote "the wrong way" on a ballot referendum, but there's been a big backlash against courts that overthrow anything passed by popular means unless it's clearly unconstitutional or otherwise illegal.

This decision merely upheld Prop 8 against a very specific state constitutional law attack that Prop 8 should have been regarded as a constitutional revision, which would have required it to be passed by the legislature before being voted on by the people, which it wasn't, rather than an amendment, which can be passed by a direct vote of the people. Not saying that it's right or wrong, but it's really not that complicated and people who purport to be outraged about this should at least understand what they're outraged about.

To be fair, and I know this isn't the site for that, so I'll apologize in advance (Especially after #89's idiotic post) for looking like I'm supporting the content of Prop 8. The court did NOT rule on equal rights or equal protection issues, the grounds on which Prop 8 was challenged, from what I understand, anyway, was the procedure by which the constitution was amended. The question was whether the constitution was amended or modified, the judges ruled that it was in fact amended and that the procedure, though ridiculously simple, was valid. They did comment on how silly it is that the constitution can be amended so easily.

So people who think that this was a loss or a set back for equal rights, it wasn't. There are other ways to challenge this that will probably be coming. I think that the anti-prop 8 people went about this the wrong way.

There's no difference between legalizing gay marriage and legalizing incest.

According to GMers, marriage has nothing to do with having kids and everything to do with privacy. Well the legal justification for banning incest is that it causes f***ed up kids (in addition to the practical justification that it's repulsive).
