Well, I can't believe I'm defending Sharon Stone, but I believe the issue was that she wanted to get custody and take him out of the Bay Area, where he's lived all along. The court found it wasn't in his best interests to uproot him and gave custody to the Dad to stop them from shuttling him back and forth. When they say "unless there's a change in circumstance" they almost certainly mean that they'll make it joint custody if she moves to the area. And no, the courts don't automatically award custody to the mother any more. Joint is the default these days.
