Aug 23 2007Lindsay Lohan gets one day in jail

Lindsay Lohan has struck a deal by pleading no contest to two counts of DUI and will serve 10 days community service and one day in jail (the minimum sentence of four days was cut in half by the judge, and she was also credited one day for the time served when she was arrested). Lindsay also pleaded guilty to two counts of being under the influence of a controlled substance and pled no contest to reckless driving. The judge ordered Lindsay to serve 36 months probation and attend an alcohol education program for 18 months, as well as enroll in a drug program and "not to associate with people with controlled substances." Lindsay issued the following statement:
"It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs.Recently, I relapsed and did things for which I am ashamed. I broke the law, and today I took responsibility by pleading guilty to the charges in my case. No matter what I said when I was under the influence on the day I was arrested, I am not blaming anyone else for my conduct other than myself. I thank God I did not injure others. I easily could have.
I very much want to be healthy and gain control of my life and career and have asked for medical help in doing so. I am taking these steps to improve my life. Luckily, I am not alone in my daily struggle and I know that people like me have succeeded. Maybe with time it will become easier. I hope so."
She sounds pretty serious about getting healthy, but one day in jail? For seven misdemeanors, including driving with a blood alcohol level almost double the legal limit and trying to run somebody down in her car? I waved at a police officer the wrong way once and got a worse sentence.

OMG!!! you know if she wasnt "famous" she would have gotten the coke charges & the DUI charges, which should have been a minimum of at least 6 months.... our legal system is seriously fucked up. if i was the judge, i wouldnt have cut her sentence in half, or credited her the time she was arrested. SHE WAS DRIVING DRUNK & HAD COCAINE ON HER!!!!!! yes, she has a problem, but that shouldnt be an excuse. the "normal" coke-whores who get picked up or other drunk drivers, or those who do both dont just get 1 day & 10 of community service. fucking idiots. & not to mention that this was her second offense, so that should have added another 6 months to a year to her 6 month sentence

I think the prison overcrowding is more the 'drug war' thing than a race thing. In 1970, about 16% of Federal incarcerations were drug-related. In 2002, it was 54.7%. If we legalized drugs, we'd empty half the cells in the federal pen.

Of course the sentence is not just. There's no consistency in judges or sentencing. One of the worst problems with our court system. Depending on the judge, a child rapist might get off with probation while a man who does a "hit and run" on a dog, no substance abuse involved, just a mistake, and a DOG, can go to prison. (The former is often on the news, the latter happened to a guy I know of.) It's utterly stupid and completely unfair regardless of fame.
I don't know if LL is sincere or lying. Probably lying? Time will tell. But if she's sincere, I wish her the best, and I hope she can turn her life around. I love to make fun of these hollywood morons, but I won't step on her if she's really trying to improve.

Can anybody explain why charges were never filed for her first DUI until now? She got arrested, went through rehab, got out, got another DUI went back to rehab and still no charges filed until now?
Well here's the thing, Paris didnt do any time until she violated probation...Linday just started probation today....so if she screws up again in the next 3 years she will do time.

The drug war thing IS a race thing.
Crack is a black drug, powder cocaine is a white drug. Current policy generates a 100 to 1 penalty ratio for crack-related offenses. For instance, distribution of only 5 grams of crack cocaine (about a thimble full) yields a 5 year mandatory minimum sentence. It takes 500 grams of powder cocaine, however, to prompt the same sentence. Crack cocaine is also the only drug for which the first offense of simple possession can trigger a 5 year mandatory minimum sentence. Simple possession of any quantity of any other substance by a first time offender – including powder cocaine – is a misdemeanor offense punishable by a maximum of one year in prison. Crack is the only drug for which the first offense of simple possession triggers a federal mandatory minimum sentence (possession of 5 grams of crack will trigger a 5 year mandatory minimum sentence).
That's why there are so many blacks in prison. Federal laws were written specifically to lock up low-level street dealers (mostly black) for an average of 10 years, more than twice as long as rapists. Users and dealers of powder cocaine continue to be prosecuted under much more lenient standards, as shown by Lindsay's case. If she had crack cocaine in her pocket, she'd be doing real time. But what are the odds that middle- or upper-class white kids are walking around with crack (not powder cocaine) in their pockets? Enough with the outrage about Lindsay's case - you all voted for the people who make and enforce these laws, probably because they said the drug addiction problem needed a "war" mentality. It's war, all right - class and race.

Shit yeah, it made a huge difference that Lindsay had a little powder in her pocket, and not crack. Multiple DUIs are a different matter, but nobody should be surprised about the lack of punishment for a lil' packet of powder. The zero-tolerance psycho states are different, but in most places the older laws haven't been changed and you're looking at a misdemeanor (maybe) unless you have a full baggie of something. In the good old days, the cops would just take your drugs away (for personal use or resale) and let you off with a warning if you had no priors. But then there was the crack "epidemic" followed inevitably by a "war" on it. Just like in Iraq, it helps enormously when the enemy's skin is dark.

I think it's a brave thing for Lindsay to completely tell the truth and admit that she's addicted to drugs and alcohol. That's a big step for ANYBODY to admit publicly, so I applaud her for it. Plus, that's exactly what the law wanted, was for one of these high-profile celebrity chicks to cough up the truth about the true extent of their substance abuse, so she made the right move by giving the L.A. courts exactly what they wanted.
I just hope she gets a grip on herself enough to NEVER get busted again. If she's intoxicated somewhere, she has to get a cab, and if she's buzzed at home she has to take a cab from home. Also, she has to be street-smart enough to NEVER carry drugs on her in public or in a vehicle again. If she does have a relapse, she needs to NEVER drive or leave the house with drugs in her purse or on her person. THE LAW GIVES ONLY ONE SECOND CHANCE!!! The next time she gets busted, she'll probably get a year in L.A. county jail in the general population. They did it to Little Kim, they'll do it to her.
The last time I was in court in L.A., the judge came out in his spooky black robe and there were two hot blond court clerk chicks in matching blood-red oufits, and I suddenly had a frightening revelation that it was like I was appearing before the devil and his demons and I was standing at the very gates of Hell. The courts have the power to destroy your life, and I think they secretly enjoy sending people to jail, so if you give them the opportunity, they will eagerly send you to Hell. I've been here a few years, but to those of you still on the other side of the pond, their laws may have changed to prevent them from acting on their bigotted instincts over here, but for the most part, their attitudes are about the same as they ever were - anyone darker than a sun-tanned white isn't worthy of equal treatment.

she will fuck up again. she now has years of probation. so when she is in trouble in the next few months, she will get a harsher sentence. a sentence like 2 days and five minutes.

Katie (#90), judging by the grammar alone, Lindsay had nothing to do with this statement. If she had actually written something herself it would probably just be the usual "i didndt due it guyz!!! believe me!!1" and then go off on a random tangent about ponies and how she also never fucked joaquin phoenix.

The reason the judge was able to give her so little time and the reason she will probably spend little or no time in jail is that the DA Steve Cooley reduced felony charges to misdemeanors. Since when is possession of cocaine a misdemeanor? And twice?
THAT is how celebrities get off.
You can only get out of jail early for overcrowding if your original sentence is less than 90 days. A felony charge carries a longer sentence than that. So they get chaged with misdemeanors, and then judges give them light sentences for serious crimes.
For instance actress Rebecca Gayheart pled guilty to misdemeanor vehicular manslaughter and got off with a fine.
The problem begins with the DA. Instead the media covers up for the DA and tries to blame the Sheriff who is following the law.
Everything here favors Hollywood. It's sick.

Karen is right. I don't actually blame the judge for this so much as the idiot district attorney for going along with the insane setllement offer proposed by Lohan's attorneys. I'm a prosecutor in Baltimore and it seriously pisses me off when I see other prosecutors pull this crap. No way would I or any of my colleagues EVER accept a plea deal like this one- especially for someone who committed back-to-back offfenses! I mean, they hadn't even gotten a chance to charge her for the original DUI before she went out and did it again for Christs sake! From what I've read, they had more than enough evidence to go forth with prosecuting her, but for some asinine reason, chose not to. That seems to be the trend in L.A. lately. I don't know what the hell the judges and attorneys have been drinking down there.
And #96 is right too. I feel like a "no contest" plea is even more of a kick in the face, because she's accepting the punishment without admitting guilt! She will never have to stand up and up in a courtroom and say "yes I'm guilty, I did everything I'm accused of." I agree that her "statement" seems a little too articulate, with correct spelling and semantics and everything, to have actually come from her. That has "PR" written all over it.

Okay, one last thing I have to comment on, I promise) I keep seeing various people commenting about how it's not fair that Lindsay had to serve only 1 day in jail while Paris had to spend several weeks in jail for "just driving on a suspended license." Alright guys, we need to get this straight! Paris did not "just" drive on a suspended license. That's not what got her jail time. She VIOLATED HER PROBATION. That's incredibly serious. So serious, in fact, that jail time is required for it. The judge in Paris' case was actually incredibly fair and could have given her alot more time to serve. Paris was actually pulled over several times for driving on a suspended license and it was only after about the 3rd or 4th time that the cops finally say, "enough is enough" and charged her with violating her probation. Paris wasn't "victimized" by the courts; she actually got off pretty light. Don't forget that she didn't originally get jail time for her DUI offense either. She violated the probationary terms of her DUI offense and THAT'S what earned her a trip to the pokey. While I agree that Linday's sentence is b.s., if she violates her probation like Paris did, I can assure you she'll wind up serving time also. Sorry if I sound preachy guys, but it's just driving me nuts that people (and I blame the media for their inaccurate reporting) keep misrepresenting what Paris did, thereby lessening the severity of her actions.

@82 - this thread is probably dead by now, but I can't believe nobody posted the obvious comeback to your comment. One word: meth. An "epidemic" just as widespread, and just as violent as crack in the 80s, with meth addicts doing daily petty crimes and meth dealers fighting over the monster profits to be had. This big difference is that the meth scene is overwhelming white, not black. So, laws were written for meth to match the severity of the crack laws, right? Of course not. Don't be silly.
