Well, It actually IS. In Ca. you have to drive a "safe distance" from the car in front of you as warrented by traffic, so that if they slam on their breaks you have room to stop. Basically in Ca. if you rearend somebody it is pretty much always your fault.

She was not paying attention to the road, didn't notice that traffic had slowed, she committed vehicular homicide. Anybody else would have been hauled in trust me. She will have a tough time getting out of this one.

Brandy will be liable for (1) negligence (civil). This means the poor lady's family will sue Brandy under a wrongful death action, Brandy's insurance company will pay out, and then Brandy's insurance company will sue her back to recover a shitload of money. Brandy will have to pay the poor women's family any amount (which could be considerable) that her policy did not cover.

Brandy will also possibly be liable for (2) criminal negligence. Driving 65mph on the freeway might not qualify, because usually it's something like driving 70mph in a 25mph zone and then, striking and killing someone. This was a fluke accident. She's liable. But she might not be criminally liable.

Either way, Brandy's out a MAJOR chunk of cash, feels like ASS for just killing someone, and will basically lose her insurance policy when all is said and done.

I've been reading the stuff on here for a while, and I usually think it's funny. The superficialness amuses me and I agree with it most of the time, or at least understand the point. The other news on this site is humorous, but this is serious. It was vehicular manslaughter and she should be charged with it just like any other person would be charged. She was careless and caused another person to die through her own negligence. Whether she CHOSE to pull the trigger and kill someone willingly, or she CHOSE to be a negligent driver (drinking, talking on cell, getting a hummer) her choices caused the death of another human being. Being negligent is not as bad as intent but the law doesn't let either one slide especially in these cases.

But since she's such a unique specimen (them eyes!) they probably won't want to keep her in captivity. In her defense I don't know how she can see the etire road, that would be like my greyhound trying to drive a car.
